Terms of Service for Something
These terms are a contract between you and BAARS DESIGN for the use of Something, a macOS app that lets you change a web product on a canvas and send the result to a developer as a pull request.
By creating an account, buying a plan, or using the app, you accept these terms. If you accept them for a company, you confirm you are allowed to bind that company.
1. Who we are
BAARS DESIGN is a sole proprietorship (enkeltpersonforetak) registered in Norway.
- Organisation number: 938 054 037
- Owner: Ronald Baars
- Email: support@changesomething.app
- Registered address and all other company details: the Company information page
2. Definitions
- App: the Something desktop application for macOS, including updates.
- Service: the App together with the account, billing and team features we run for it.
- Plan: Free, Solo, Team or Enterprise, as described on the pricing page.
- Editor seat: the right for one named person to send changes from the App. Reviewers who only look at pull requests on GitHub need no seat and no account.
- Organisation: a team account that holds seats and members.
- Customer content: the project files, code, designs, prompts, branches and pull requests you work on with the App.
- Consumer: a natural person who buys the Service for purposes that are mainly outside their trade or profession.
- Business customer: anyone who is not a consumer.
3. Who may use the Service
You must be at least 18 years old to buy a plan. To use the Free plan with an account you must be at least 13, the age at which Norwegian law lets a person consent to an online service themselves (personopplysningsloven § 5). The Service is built for professional use.
4. Accounts
You can use most of the App without an account. You need one for paid plans, teams, and the features listed on the pricing page.
You sign in with Google, Apple, or a code sent to your email. The App stores your session in your Mac’s keychain and never writes it to a file. Keep your Mac and your sign-in method secure, and tell us at once if you think someone else is using your account.
An organisation’s owner or admins control who is a member and who has a seat. When you join an organisation, its admins can see your name, email and seat status, and can remove you.
You can delete your account at any time by emailing us, or yourself from your account settings where the Service offers it. Deleting the account does not delete anything on your Mac. The Privacy Policy says what we keep afterwards.
5. The licence
We grant you a personal, non-exclusive, non-transferable licence to install and use the App on Macs you control, for the plan you hold, for as long as these terms are in force.
Except where the law allows it regardless of this clause, you may not:
- copy, sell, rent, sublicense or redistribute the App;
- remove or change notices in the App, or its code signature;
- work around the plan checks in the App;
- use the App to build a competing product by copying its design or behaviour;
- use the Service in a way that breaks the Acceptable Use Policy.
Plugins you write with the plugin system are yours. The plugin interfaces are published so you can build on them.
The App bundles open-source components under their own licences. Those licences ship with the App and we send them on request.
6. Plans, seats and trials
The pricing page lists what each plan includes. In short:
- Free: one project, and pull requests to repositories you own on your personal GitHub account. Free is for individuals.
- Solo: one editor seat for one person, up to five projects, and pull requests to repositories owned by GitHub organisations.
- Team: editor seats for a team, three at least. Unlimited projects, linked design-system repositories, and an organisation with invites and seat management.
- Enterprise: Team on a yearly contract, with invoice or purchase-order billing, the Data Processing Agreement, and single sign-on, directory sync and audit-log export where the agreement includes them. Enterprise is sold under a separate agreement, which takes precedence over these terms where they differ.
Pull requests go to GitHub only for now.
A seat belongs to one named person. An admin can move a seat to someone else at any time. The person who loses it keeps paid features until the App next checks in, which happens once a day while the Mac is online. Sharing one seat between several people is not allowed.
Trial. You can start one 14-day Team trial, once per account and once per GitHub login. No payment card is needed. The trial ends by itself unless you buy a plan. Nothing you made during the trial is lost; the App falls back to the Free plan.
Reviewers are free. A developer who reviews or merges your pull request on GitHub needs no seat, no account and no App.
Offline use. The App checks your plan with a signed token that is valid for 7 days and renewed in the background. If your Mac is offline, paid features keep working for 14 more days after the token expires. After that the App falls back to the Free plan until it can reach our server again. Nothing on your Mac is locked or deleted because of billing.
7. Prices, payment and taxes
Prices. Current prices are on the pricing page. Enterprise is priced by quote and billed yearly. We may offer fixed local prices in other currencies; they are set prices, not live conversions.
Taxes. Prices on the pricing page are shown without VAT. At checkout we add the tax that applies where you are, from your billing address, where we are registered to charge it. The Company information page says whether BAARS DESIGN is VAT-registered. Checkout shows the total, including any tax, before you pay. A business can enter its VAT number at checkout; where reverse charge applies, the business accounts for the VAT under its own rules.
Payment. Stripe processes payments. We never see or store your full card number. You authorise us to charge your payment method for each billing period and for seats added during a period. Seat changes in the middle of a period are charged or credited for the days that are left.
Renewal. Plans renew automatically at the end of each monthly or yearly period until you cancel. We email you a reminder at least 30 days before a yearly plan renews.
Failed payments. If a payment fails, we retry it and email you. Your plan stays active for a grace period of 14 days. If the payment still fails, the plan is cancelled and the App falls back to the Free plan. Nothing on your Mac is affected.
Price changes. We can change prices. For an existing subscription the new price applies from the first renewal after we have given you at least 30 days’ notice by email. If you do not agree, cancel before that renewal and you will not pay the new price. On a yearly plan your price is fixed until the end of the paid year.
Invoices. Each payment produces an invoice or receipt, emailed to you and available in your account. Norwegian business customers may receive it as an EHF e-invoice where the law requires it.
Bank fees. Your bank may charge conversion or foreign-transaction fees. Those are not ours.
8. Cancellation and refunds
You can cancel a plan at any time from your account or by email. Cancelling stops the next renewal. Paid features keep working until the end of the period you have paid for.
Refunds, including the 14-day right of withdrawal that consumers have under Norwegian law, are covered in the Refund and Cancellation Policy. That policy is part of these terms.
9. Your content and your code
It stays yours. You own your customer content. We claim no rights in your code, designs, prompts or pull requests.
It stays on your Mac. The App works on files on your Mac. Your project files, code, prompts and AI responses do not pass through BAARS DESIGN’s servers. The Privacy Policy lists what does reach us: account details, plan state, organisation membership and the devices you use.
No training. We do not use your content to train AI models, and we have no access to it to do so. Your AI provider’s rules on training are between you and that provider; see section 10.
Your responsibility. You are responsible for having the right to change the repositories you open with the App and to send pull requests to them.
10. AI engines are yours, not ours
The App does not include an AI model and carries no AI key of BAARS DESIGN.
To use AI features, you connect your own engine: a Claude Code, Codex or Gemini CLI subscription already installed on your Mac, or an API key from Anthropic, OpenAI or Google that you store in your Mac’s keychain. Your code, prompts and context then go straight from your Mac to the provider you chose, under that provider’s terms and privacy policy. BAARS DESIGN is not a party to that traffic and cannot see it.
That has three consequences:
- Any cost of AI usage is between you and your provider.
- AI output can be wrong. The App shows you every change before it is committed or sent, and a developer reviews the pull request. You are responsible for reviewing changes before you merge them into your product.
- If your provider is down or refuses a request, the AI features will not work. That is not a defect in the Service.
11. Third-party services
The Service connects to services run by others:
- GitHub, to list your repositories and, through the GitHub CLI on your Mac, to push branches and create pull requests. You use your own GitHub account and your own token, stored in your Mac’s keychain. GitHub’s terms apply to your use of GitHub.
- Google and Apple for sign-in, if you choose them.
- Stripe for payments.
- Your AI provider, as described in section 10.
We are not responsible for those services, their availability, or changes they make. If a change on their side breaks a feature, we will try to fix the feature within a reasonable time.
12. Updates
Installed copies of the App look for updates about 30 seconds after start and then every four hours, and download them in the background. The App never restarts by itself: an update is installed when you quit the App, or straight away if you choose Restart to Update. We may require an update to keep paid features working, for example to fix a security issue, with reasonable notice.
Updates can add, change or remove features. We will not remove a feature that is central to a plan you have paid for during the paid period without offering you a refund for the rest of that period.
13. Beta features
Features marked beta, preview or experimental may be incomplete, change without notice, or be withdrawn. Do not rely on a beta feature for anything you cannot afford to lose.
14. Availability and support
The App runs on your Mac and most of it works without our servers. Sign-in, plan changes, teams and billing depend on our server and on Stripe, Supabase, Oracle Cloud and GitHub.
We aim to keep those services available, but we make no uptime promise and offer no service level agreement except in a signed Enterprise agreement. We announce planned maintenance where it affects sign-in or billing.
Support is by email. Solo plans get email support, Team plans priority email support, and Enterprise a named contact with the response times in the Enterprise agreement. Free plans may use the community channels listed on the website.
15. No warranty
The Service is provided as it is and as available. We do not promise that it is free of errors, that it will meet your needs, or that the pull requests it produces are correct. We exclude all implied warranties to the fullest extent the law allows.
If you are a consumer, this section does not limit the rights you have under mandatory consumer law (see section 21). If the Service does not conform to the contract, you have the remedies that law gives you.
16. Liability
To the fullest extent the law allows, BAARS DESIGN is not liable for any loss or damage arising from or connected with the Service, these terms, or your use of the App, whatever the legal basis of the claim. That includes direct and indirect loss, lost profit or revenue, lost data, business interruption, and loss caused by third-party services (including your AI provider and GitHub) or by changes you merge into your product.
This section does not exclude or limit liability that Norwegian law does not allow to be excluded, including:
- liability for loss caused by our gross negligence or intent;
- liability for personal injury;
- the rights consumers have under mandatory consumer law, such as angrerettloven, digitalytelsesloven and, where it applies, forbrukerkjøpsloven. Those rights stay as the law gives them.
If a court finds any part of this section unenforceable, that part applies to the greatest extent the law permits and the rest of the section stays in force.
17. Indemnity by business customers
If you are a business customer, you will defend and compensate us against third-party claims that arise from your customer content, your use of the Service in breach of these terms, or your breach of the law, except to the extent we caused the claim.
18. Suspension and termination
By you. Cancel at any time (section 8). Delete your account at any time (section 4).
By us. We can suspend or end your access if you materially breach these terms, do not pay, or use the Service in a way that harms others or the Service. Where reasonable we warn you first and give you a chance to fix the problem. If we end the contract without you being in breach, we refund the unused part of any period you have paid for.
What survives. The sections on your content, liability, indemnity and governing law, and anything else that by its nature should survive, survive termination. Everything on your Mac stays on your Mac.
19. Changes to these terms
We can change these terms. For material changes we email account holders and show a notice in the App at least 30 days before the change takes effect. If you do not agree, cancel before then. Continuing to use the Service after that date means you accept the new terms. Changes the law requires, or that only add a new feature, can take effect sooner.
Each version of these terms is dated. Earlier versions are available on request.
20. Governing law and disputes
These terms are governed by Norwegian law.
Business customers agree that disputes go before Oslo tingrett, unless mandatory law says otherwise.
Consumers keep the right to bring a case in the courts of the country where they live, and to rely on that country’s mandatory consumer rules where they are more favourable. Consumers in Norway can also ask Forbrukertilsynet for mediation at https://www.forbrukertilsynet.no/send-sak-til-mekling.
21. If you are a consumer
Most of these terms apply to everyone. These points apply only to consumers:
- You have a 14-day right of withdrawal under angrerettloven, as described in the Refund and Cancellation Policy.
- Sections 15 and 16 apply only as far as consumer law allows.
- Changes to the Service follow digitalytelsesloven §§ 41 and 42 (section 12).
- The venue clause in section 20 does not bind you.
22. Enterprise agreements
Enterprise customers sign an order form and, where we process personal data on their behalf, the Data Processing Agreement. Where an Enterprise agreement conflicts with these terms, the Enterprise agreement wins.
23. Other terms
- These terms, the Refund and Cancellation Policy, the Acceptable Use Policy, the Privacy Policy and, for Enterprise, the signed agreement, are the whole contract between us.
- If a clause is found invalid, the rest stays in force.
- We can transfer this contract to a company that takes over the business of BAARS DESIGN, with notice to you. You cannot transfer it without our consent.
- We are not liable for delays caused by events outside our reasonable control.
- These terms are written in English, and only the English text applies.
